Terms of Service

1. Agreement

These Terms of Service govern your use of the Untabbed mobile app and any related Untabbed services (collectively the "Service"). By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.

2. Eligibility and age verification

You must be 21 or older and legally able to purchase alcohol where you live. By using the Service, you represent that you meet this requirement.

The licensed venue's bartender verifies your government-issued ID before serving you. Untabbed itself does not verify your ID — Untabbed only collects your stated date of birth at signup so that we can refuse the app to anyone who tells us they are under 21. Providing a false date of birth, or attempting to use the Service to obtain alcohol if you are under 21, is grounds for immediate account termination and may expose you to civil and criminal liability.

3. The Service

Untabbed is a technology platform that lets you open a tab, add drinks, and pay at participating bars and venues. Untabbed is not a licensed alcohol retailer or distributor and does not sell alcohol. The licensed venue is the seller of every drink. Untabbed facilitates ordering and payment.

4. Accounts

You are responsible for everything that happens under your account. Keep your password and your device secure. Notify us at support@untabbedapp.com if you suspect unauthorized use of your account.

5. Payments and billing

Payment processing is handled by Stripe, Inc. By saving a payment method, you also accept Stripe's Terms of Service.

When you open a tab, Untabbed places a payment-authorization hold on your card. The hold is captured or released when the tab closes:

• If you close the tab yourself, we capture the running total plus any tip you select.
• If you do not close the tab, the Service automatically closes it shortly after the venue's posted closing time and captures your running total plus a default tip.
• If your card is declined at capture, the venue may pursue you directly for the unpaid amount.

All sales are final. Refund decisions are made by the venue. Untabbed will assist the venue and Stripe with any chargeback or dispute.

6. Responsible use

You agree to use the Service responsibly and in compliance with all applicable laws. You will not:

• Buy alcohol for, share with, or transfer alcohol to anyone under 21.
• Provide a false ID, false age, or false identity at signup or to a venue.
• Misuse the pickup-code or QR-code system.
• Use the Service to commit fraud, harass other users, or harm any venue or its staff.
• Interfere with, reverse-engineer, or scrape the Service.

7. Friend features and content

Untabbed lets you add friends, see each other's public status, and report or block other users. You may not impersonate anyone else, set a username or display name that is harassing, hateful, or sexually explicit, or use the friend features to harm anyone. We may filter, hide, or remove names and content that violate these rules; we may suspend or terminate accounts for repeated or serious violations.

8. Termination

You may delete your account anytime in Settings. We may suspend or terminate your account for violation of these Terms, fraudulent activity, repeated chargebacks, or abuse of other users or venue staff. After termination, sections 5 (Payments), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 12 (Dispute Resolution) survive.

9. Disclaimers

The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We do not guarantee the accuracy of pricing, menu availability, drink quality, or wait times — those are the venue's responsibility.

10. Limitation of liability

To the maximum extent allowed by law, Untabbed LLC and its officers, directors, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability to you for any direct damages will not exceed the greater of $100 USD or the total amount you paid through the Service in the six months before the claim.

We are not liable for the actions, service, or product quality of any venue, its employees, or any rideshare provider linked from the Service.

11. Indemnification

You agree to indemnify and hold Untabbed LLC harmless from any claim or demand made by a third party arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

12. Dispute resolution and governing law

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts of Connecticut, and you and Untabbed each consent to jurisdiction there.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the app or by email and the "Last updated" date will change. Continued use after a change means you accept the updated Terms.
